kan hergebruikt worden door het publiek
 welke de voorwaarden zijn voor dat hergebruik

3. Gelaagd licentiemodel
 De matrix geeft een antwoord op volgende vragen:
 Welke content stellen we ter beschikking,
 onder welke voorwaarden,
 en voor welk soort hergebruik?
 één systeem voor alle participerende musea van de
VKC => juridische duidelijkheid voor het publiek
 Zo eenvoudig mogelijk => gebruiksvriendelijk

4. Externe aanleiding
 Juridisch en economisch: PSI-directive, ondertussen omgezet
in Vlaams decreet en federale wet en bijhorende actieplannen
 PSI = Public sector information
 Overheid: Al wie met overheidsgeld werkt: ook voor bewaarbibliotheken,
archieven en musea
 Content/data moet zoveel mogelijk gratis ter beschikking gesteld worden
aan al wie daarom vraagt
 Er is geen discriminatie mogelijk ten aanzien van potentiële afnemers
 Uitzonderingen op de regel:
 niet voor content/data die onder het auteursrecht valt
 bibs, arch° en musea kunnen beperkte kostprijs (marginale kost) vragen
 privacy en veiligheid
 Federaal actieplan: vrij van bronvermelding, ook Vlaams beleid neigt
daarnaartoe (maar nog geen wettelijke verplichting voor
erfgoedspelers!!!!)

we actief zijn: wat stellen we wel/niet ter beschikking

6. Externe/interne aanleiding
 Voortschrijdend inzicht:
 groeiende open knowledge community
 grote en gerenommeerde bewaarinstellingen stellen vrij data
en beelden ter beschikking
 Economische ratio: Zie Nederland: Rijksmuseum, Van Gogh-
museum, …: er zit ook een business logica achter: goede producten
biedt men ook aan in de museumshop
 Bestuurlijke ratio: Zie Antwerpse Stedelijke musea: wat met
publieke middelen betaald is kan ook aan het publiek en
hergebruikers worden teruggegeven
 Erfgoedspecifieke ratio: de collectie en de instellingen zo goed
mogelijk bekend maken

 PSI-decreet: stelt in uitvoeringsbesluit zelf licenties voorop
 Technische implementatie (vertaling principes in datahub,

eigenaar)
 Vragen en verzuchtingen van derde partijen: Lukas, art in
Flanders
 Strategische inzichten: loyauteit naar de uitgever van een gedrukte
publicatie

 Er zijn drie soorten content
 Data uit de registratiesystemen
 Identificatiedata
 Beschrijvende data: proza en kunsthistorische documentatie
 Data waarin privacygevoelige content zit
 Data waarin veiligheidsgevoelige content zit
 Foto’s (voorlopig enkel foto’s van collectiestukken)
 Onderscheid tss Public domain werken en in copyright werken
 Onderscheid tss foto’s in hoge resolutie (min.1920 pixels) en foto’s in
lage resolutie (max. 1920 pixels)
 Beschikt het museum/Lukas over de auteursrechten op de foto’s? Ja of
neen
 Teksten (van websites en gedrukte publicaties)
 Is het museum eigenaar van de auteursrechten? ja of neen
 Worden de teksten gebruikt voor digitale of gedrukte publicaties?

postkaart)

12. Gelaagd licentiemodel: welke licenties
 Privacygevoelige gegevens:
 Wat? De naam van een schenker of verkoper (indien een privaat
persoon), de wijze waarop een kunstwerk van deze schenker of
verkoper werd verworven (betaling van belastingen, betaling van
erfenisrechten, schenking, verkoop) en de voorwaarden die hierbij
werden gesteld
 Dergelijke contact wordt pas vrijgeven wanneer de schenker of
verkoper reeds 20 jaar is overleden.
 Wanneer de schenker of verkoper schriftelijk te kennen gaf anoniem
te willen blijven zal dit worden gerespecteerd en zal de naam van de
schenker of verkoper nooit via de datahub of andere digitale kanalen
worden vrijgegeven.
 Problemen:
 De registratiesystemen zijn niet klaar voor dit soort content
 De basisregistratie van dit soort informatie staat lang niet op punt
 Technisch zeer moeilijk en op korte termijn zelfs niet implementeerbaar!
=>Velden met eventuele privacy-gevoelige informatie zal, op korte termijn,
niet worden vrijgegeven

13. Gelaagd licentiemodel: welke licenties
 Veiligheidsgevoelige gegevens
 Wat? Bewaarplek in het depot, verzekerings- en
aankoopwaarden, transportdata bij bruiklenen, …
 worden niet meegedeeld of voor hergebruik ter beschikking
gesteld.
 Privacy- en veiligheidsgevoelige gegevens: op
termijn mogelijks een tweede datahub, enkel voor
intern gebruik.

14. Gelaagd licentiemodel: welk soort hergebruik?
 Soorten hergebruik: educatie, studie,
wetenschappelijk onderzoek, commercieel of niet-
commercieel, analoge of digitale publicaties, gebruik
in tentoonstellingen, in theater, via televisie, …
 Voor de data vertrekken we expliciet niet vanuit het
soort hergebruik. We formuleren onze licenties
naargelang de soort data/content, ongeacht het soort
hergebruik.
 Voor de foto’s houden we, gezien de huidige licenties
van Lukas, Art in Flanders, voorlopig wel nog rekening
met het soort hergebruik: bijv. foto’s in groot formaat
worden wel vrijgegeven voor educatief en
wetenschappelijk gebruik

15. En nog …
 De vermelde licenties per content zijn consensus-licenties.
Musea kunnen steeds opteren om een licentie met minder
restricties te kiezen.
 Hoe minder restricties, hoe beter!
 Maar … technische implementeerbaarheid!
 Het licentiemodel zal als aparte pagina op de datahub (en alle
VKC-websites) voor hergebruikers beschikbaar zijn.
 Records die niet worden vrijgegeven komen niet in de
datahub.
 Velden die niet worden vrijgegeven worden weg gefilterd op
basis van een configuratiebestand dat gebruikt wordt in de
Catmandu-tool (de tool die de ruwe data uit de
registratiesystemen omzet in een standaard Lido-XML-
formaat)
