Andrew Jackson Indian Removeal Policy Essay
Was Andrew Jackson s Indian Removal Policy Motivated by Humanitarian Impulses? Authors:

summary comparison of views regarding the Indian Removal Act of 1830, Was it an act of
humanitarianism intended to help and save the Native American culture from the white settlers, as
Robert V. Remini has argued? Or was his intent to destroy the tribal culture and to get rid of the
Native Americans, as Anthony F.C Wallace has argued? Robert V. Remini argues that Andrew

Jackson s removal policy did not sit well with a lot of groups; many were uncomfortable about it
but agreed it had to be done. President Jackson showed great leadership apart from everything
else, and handled the Indian Removal act when no one else wanted to address the growing issue of
Indian problem. Most government officials saw little to gain from addressing this and would do
nothing. Some historians believe the president s motivation was clearly out of concern for the
Indians customs, their culture and their language, but his first concern was the safety of the
military, Indians occupying the east might jeopardize the defense of the United States. In
December of 1830 President Jackson would submitted the Treaty of Dancing Rabbit Creek to
congress, it would be the first to win Senate approval. President Jackson wanted everything to go
smoothly so that the American people would see that he was humane and that this Treaty would
benefit both the Indians and the American nation at large. With Jackson located too far away to
oversee the actual removal of the Choctaw Nation, they would endure mismanagement, theft,
corruption, and inefficiency on a level that would lead to their destruction. Jackson would be
deeply offended and the removal of the Choctaw Nation would become one of the worse horror
stories of modem era. Anthony F.C

Short Story Burn 3 By Kami Garcia
In the short story Burn 3 by Kami Garcia, the author s created world can be identified as a
dystopia because of the characters fear of the outside world, and their society s banishment of
the natural world. In Burn 3 , a girl named Phoenix and her sister Sky live in a post apocalyptic
world in which the ozone layer has been destroyed, leaving the surface of the Earth to be burned
by the Sun s intense UV radiation. Humans live in Domes, which are constructed environments in
which there is a protective shield over an area where humans are able to live above ground. One
day, Phoenix s sister Sky is kidnapped, and taken into the tunnels beneath the Dome to have her
skin removed and sold to those who have been burned by the Sun s rays. Through the help of one
of the people living in the tunnels, Sky and the other children who have been kidnapped are saved
from their death, and return above ground.... Show more content on Helpwriting.net ...
The characters live under a Dome that was built to protect them from the world that has now
become dangerous. From the excerpt, The Dome is supposed to protect us from the holes in the
ozone layer holes that turned more than two thirds of the world to ash twenty years ago (Garcia 4).
In this world, the citizens greatest fear is of the outside world, and not without reason. The Dome is
the only thing standing between the humans and the fatal rays from the Sun. This intense fear is
indicative of a dystopian society in the

Teaching 1st Grade Students How to Count Rationally to 15...
Teaching 1st Grade Students How to Count Rationally to 15
This essay will explore how I would teach a group of 10 first grade students to count rationally to
15 assuming that all of them are already able to count rationally to 10. I shall explain how I would
ensure that students understand each of the four rational counting principles of one to one
correspondence, the stable order rule, the order irrelevance rule, and the cardinality rule. I shall
present an assessment I would use to evaluate student mastery of rational counting to 15. Finally, I
shall discuss how I would adapt my instruction to accommodate English Language Learners (ELL)
and students with learning exceptionalities.
Rational counting means students apply all four ... Show more content on Helpwriting.net ...
I shall repeat this several times until I formatively assess students are transitioning smoothly from
one new number word to the next without hesitation.
5)I shall then instruct students to chorally say the numbers in sequence without me modeling as I
point to them in stable order.
6)The final step in establishing the Stable Order Rule will be to repeat each step of this process
starting from the number 1 all the way to 15.
One to One Correspondence would be the next counting principle I would address in the following
manner:
1)I would place 15 dotes on the white board in an evenly spaced horizontal pattern.
2)I would explain to students that it is important to count each dot only once and by touching,
marking, or moving an item as it is being counted will help the person counting not miss an item or
count the same item twice by establishing one to one correspondence.
3)I would verbally model count the dots from left to right pointing to and touching each one as I
said it following the stable order rule.
7)I would then ask students to repeat after me as I slowly count and say each one from one all the
way to 15. This process will be repeated several times until I formatively assess all 10 students are
confidently restating each number name including the new ones.
8)I would then have students count chorally without my modeling as I point to each dot along the
line from left to right in order from the 1st to the 15th. I shall repeat

1984 Class Structure
Humans always have had a tendency to allow the poor and miserable to suffer, even while the
wealthy continue to fatten and flourish in needed yet often unshared resources. The social order
has shaped a distinctive hierarchy composed of the High, the Middle, and the Low in an
exceedingly flawed and callous structure. This system has been implemented in our history over a
variety of ages and civilizations. More importantly, the structure has not been altered to work for
any system except for theoretical Communism and Socialism. The novel 1984 was a shock to the
masses when it was released, but by showing the class structure and political satire Orwell was able
to present not only the danger of Communism gone awry but its repercussions on... Show more

This is remarkably similar to certain viewpoints taken of the United States philosophies on politics
and the class system. According to Phillips, В… the erosion of the U.S. middle class in the 1980s
and early 1990s reflected technological change and global economic upheaval. The Reagan
administration introduced new philosophies, tentative and little understood at first, to justify
policies of redistributing tax burdens, exalting markets, over rewarding the rich and the
manipulations of financeВ… Using the previous example from Kevin Phillips, one can see how
the upper or high class will always attempt to gain more wealth and power, even at the expense of
the common good as well as the majority. The peasants and other low classes have always been
pressed on by their uppers. The Proles make up the majority of the population of Oceania, about
85%. The Party itself is only interested in their labor power, because the Proles are mainly
employed in the industry and in the farms (Gerenser). A society cannot exist without a working
class, and therefore it is the only reason why the Proles are still around. In 1984, Winston begins
to realize that the Proles may have a simpler and easier life than that of the Party. While the Outer

The Power Of Money InPaul s Case, By Willa Cather
The Power of Money
Money is usually attracted, not pursued (Jim Rohn). Willa Cather s short story, Paul s Case, is
about a teenage boy who thinks highly of himself and often tries to escape his normal life. Paul
feels the happiest at the Carnegie Hall where he is an usher. There he is not the boy everyone
hates, but he is always calm and comfortable. After Paul is taken out of school and away from the
job he loved, he feels incomplete. This story is very intriguing because it shows how not
appreciating the things you have can cause depression and many unthinkable things. Willa Cather
uses the characters in the story to show how not bothering to try and help someone, not appreciating
the things you have, and .

Because he is selfish and desperate to escape his normal life, he does not think about the
consequences of his actions nor does he appreciate what he has. Once he is forbidden from
attending his job at Carnegie Hall, we start to see the worst of Paul. Instead of talking to someone
about his problems, Paul starts to lie to his father and steal money from his employer just to try to
live the way he always wanted.
As stated before, working at Carnegie Hall was one of the few things Paul loved to do. As the
house filled, he grew more and more vivacious and animated, and the color came to his cheeks
and lips (cite). The more Paul is there the more caught up he is in the art world. In the story it
talks about how good he is at what he does. Working at Carnegie Hall was a great thing for Paul
but it was also a bad thing. It is a good thing because throughout the story it talks about how he
never feels like he fit in anywhere but there he does. It is also a bad thing because it influences
his idea of being better than everyone, his behavior in school, and the fantasy world he can never
seem to get out of his head. Once it is taken away, Paul is forced to find happiness elsewhere.
Throughout the story Willa Cather shows how unhappy someone can be with their life but never
seek help. She also shows that parents should build better relationships with his or her children
because anything could be happening and they ll never know until it is too late. Schools should do a

Livia Alternate Ending Essay
Livia tried not to put any thoughts toward her husband s new acquisition. The dark haired man
fought like a caged animal and seemed always at the ready to lunge for anyone s throat, with a
quiet sort of anger that was hard to detect. She was a bit frightened of him to be sure yet she also
was... curious. Where did one find such a creature, thrown into the Abyss and pulled back a
changed man? She never asked of the men and women her husband found in the market when
they arrived in their service, aside from a few of the body slaves who she became close with. Their
stories were often the same: prisoners of war spared harsher masters in their homeland, women

Her tone was decisive and stern, though laced with concern as the boy peeled his face from the
ground. Short blonde locks were coated in sand and a string of blood oozed from his nose,
likely from having landed in a poor position on his face. He sniffed hard and stood up as quickly
as his disoriented head would allow and went toward the medicus whose room was just below
the balcony. Livia watched him go until he was out of sight, then turned with burning eyes upon
Maximus. You are not here to take out your frustrations upon the others. There is no honour in
beating him when he has already fallen, she stated with evident irritation at his cruelty. Perhaps
she was worried this was why Cassian purchased him. Your life continues because you have been
spared the mines. You are given food and shelter in exchange for laurels in the arena. Do not
forget that. And do not raise your weapon to any of the men in jest. One day you could be
fighting with him at your back, to find your only ally would see you dead just as readily as your
opponent, Livia coldly reminded him. Her cheeks were a bit flushed from anger though it could
easily be dismissed as the heat of the morning sun, or the honeyed wine she drank from in a polished

Janet Waking
The reality of death John Crowe Ransom (Tennessee native born 1888 and died 1974), devoted
much of his life to exploring his poetic ability and philosophical tendencies. In one of his more
popular pieces, Janet Waking (published 1927), Ransom utilizes just seven short stanzas to
successfully transport readers into the middle of a complex and intricate conversation about life,
deathand the fragile line that separates the two. Ransom s theme is that the waking that he makes
reference to in the title is symbolic of a child s transcendence of innocence and naivety into the
reality of death. It is important to understand that the speaker in Janet Waking is not Janet or an
unknown third party as is the case in many works of poetry. Instead, the narrator is Janet s own
father. The... Show more content on Helpwriting.net ...
When she initially wakes up from her sleep, she is still naГЇve in her young age, and has not yet
had to face the reality of death. However, in a short moment s time she is forced to confront
death, face to face, and that innocence and nativity vanishes forever. This is the first time that
Janet s father cannot make things better for her. Chucky had been translated far beyond the
tangible world, and no one could possibly bring her back. The waking is symbolic of her exiting
the period of time that all young children experience where they are completely carefree and are
not privy to the tragedies of the adult world. Death is a very adult concept, and so this
introduction is a very important moment in her life. Janet Waking is not simply a poem about a
girl losing a pet that she loved. It is a symbolic narrative, ridden with metaphors, symbolism and
various other literary devices that is truly and genuinely about how one slips out of the bliss of
nativity and into a cold, and harsh reality. A harsh reality that we all must one day face: the

Veertebrae Body
Vertebrae, while differing slightly based on their region in the spinal column, typically consist
of a body and vertebral arch. Anterior to the arch, the body (1) is the thick, broad part of the
bone that serves to support and bear weight. Between each individual body is the intervertebral
disk space. The vertebral arch is made of several parts. Pedicles (2) extend posteriorly from the
body and curves to the laminae (2). These two parts encircle the vertebral foramen with the body.
Above and below the pedicles are the superior and inferior vertebral notch, respectively, and they
form the intervertebral foramina when stacked. Zygopophyseal joints are formed by the superior
and inferior articular processes. At the junctions of the pedicle and lamina, the transverse processes
(2) protrude laterally. The spinous process (1) is the most posterior part of the vertebrae and
projects from the junction of the left and right laminae.... Show more content on Helpwriting.net ...

The Consequences Of Video Game Violence In Video Games
Violence in video games is well known for toeing the line between entertainment and immorality.
The controversy began as early as 1976, when protestors destroyed an arcade game that revolved
around hitting human like creatures with a car. As computers grew more advanced in the next two
decades, video game violencebecame increasingly realistic ( Background of the Issue ). This
prompted the creation of the Entertainment Software Rating Board, commonly abbreviated
ESRB, in 1994 for parents to make informed decisions regarding the content their children were
exposed to. The 1999 shooting at Columbine High School fueled the debate further, drawing
potential connections between virtual violence and real world consequences ( Background of
the Issue ). In the years following, laws regarding the sale of video games with graphic violence
sprouted up across the nation. Even the Supreme Court was involved ( Background of the Issue ).
Today, as many as 97% of US kids age 12 17 play video games, contributing to the $21.53 billion
domestic video gameindustry ( Violent Video Games ). Critics of video game violence argue that
it directly increases a person s violent behavior and lowers their tendency to act for the benefit
of others. Defenders of video game violence argue that media coverage of video game violence
is heavily biased, studies that link it to acts of violence are flawed, and that video game violence
is a harmless outlet for emotions of aggression. Critics of violence in video games believe that it
increases an adolescent s tendency toward violent actions. Multiple credible organizations also
view playing violent video games as a statistical detail affecting a person s aggressive tendency.
Over 98% of American pediatricians say that children and teens become more aggressive when
exposed to violent media such as a violent video game ( Violent Video Games ). The FBI uses an
individual s violent video game history to assess the risk of a school shooting threat. The
American Psychological Association cites frequent violent video game exposure as a risk factor
that contributes to violence in teens ( Violent Video Games ). Some groups that are against video
game violence go as far as to list it as a primary cause

The Road
The Road is an enthralling movie experience of the book that brings out powerful
emotions to the audience by visually depicting the sacred connection between father and son.
The world has practically ended and it is up to the survivors to choose how they keep
living in this post apocalyptic world. Many people resort to cannibalism which our main
characters did not, for they are the good guys that are carrying the fire everywhere they go.
Through many ordeals and nightmares of being eaten, our father and son duo learns from each

Adults, especially ones with children will be able to
sympathize with the movie very well. Most parents will be able to appreciate the messages that
are being imparted from the movie to the audience, reaching the full potential of the film as
intended. Teenagers, on the other hand, would also be interested in this movie, mainly because of
its post apocalyptic genre that has been booming in the past few years.
In the movie, a lot of green screen was used, and I am surprisingly okay with it. The
movie was shot beautifully, camera angles succeeded in showing the bleak backgrounds and a
very good atmosphere creation overall. Hillcoat also likes to do a lot of close ups which would
be very corny if the actors were not able to perform as intended. One thing that bothered me at
the end of the movie is the fact that another family was following the father and the son all along.
What would be the reason for that? I feel the need for that to be justified.
Overall, the movie is quite depressing, but in a good way. It is definitely not a movie that
you can easily watch and relax to, but altogether an intense experience. This movie is also a

A Picture Can Tell Us
A picture can tell us a thousand words and ways to show us our history.
Photographers have been moving many of american s deeply and helped support the new deal

Mydans, Marion Post Wolcott, Ben Shahn, Russell Lee, Arthur Rothstein, and John Vachon, were
all photographers, during The Great Depression, who wanted to show the government what the
world had become. Every single person that is named in this background has also suffered of the

no matter if the only thing they had is a blanket above their head.
Life in the 1930 s were rough, many people lived in shacks made out of materials they could find.
Having food was a struggle as well. Many people lived off of potatoes and cabbage from what
they could grow it , since money was a rare though to have back in 1930 s. Like the mexican

Narcissistic Personality Disorder Essay
Everyone knows someone who seems to be completely wrapped up in themselves. They seem to
only care about themselves, and they seem to think that they are better than every one. Some of
these people probably have narcissistic personality disorder. This personality disorder is defined
as, ...a broad pattern of grandiosity, need for admiration, and lack of empathy (Comer, 2010, p.
531). People with narcissistic personality disorderare convinced of their own greatness; whether it
be their success, artistic skill, or beauty. They also require the constant attention and admiration of

This too is typical of people with narcissistic personality disorder. People with this disorder tend to
be very picky, or choosey, when it come to who their friends and associates are. Since they consider
themselves to be special, they think that only those who are also special are deserving of their time.
A narcissistic personality may also surround themselves with dependent personalities, because those
with dependent personalities will give them the constant praise and adulation that they require.
Again we turn to Brother John for an example, He is an excellent teacher and has inspired many
students. He has always had a group of students, usually dependent personalities... (Rosetti, 1999).
These students would often be called upon to defend Brother John when his behavior was
questioned by supervisors. Brother John using his students in this way touches upon another trait
common to those with narcissistic personality disorder. People with this disorder are often
manipulative, and use other to achieve their own ends. According to Ronald Comer, they may do
this partly out of envy (2010, p. 234). I think that it is more likely that this is just a branch of
another common character trait amongst those with narcissistic personalities, that being a lack of
empathy. People with this disorder are seldom interested in the feelings of others, and so they
probably never take those feelings into consideration when they are manipulating

Essay On Frankenstein
Mary Shelley is one of the best known authors of gothic literature. Her most famous work is the
horror novel Frankenstein which she wrote at the early age of 20. Since she was so young when
writing the novel, it is interesting to ask for her ideas and the source of inspiration for the content
of her story. In literary studies, Roland Barthes theory says that the author and so his or her life
should not be the reference point for an analysis (Jannidis et al. 182). Nevertheless in some stories,
the traces of the author are so strong and important that they cannot be ignored when analysing the
story. Therefore, this essay will examine the traces of Mary Shelley s biography in Frankenstein

Shelley s stepmother did not want the children to be highly educated due to her own only
average education. Shelley probably educated herself through reading a lot and the comings and
goings of such rare personalities as Lamb and Coleridge to the house (Sparks 13). This might
serve as an argument why books and reading are often mentioned in Frankenstein. Education is
also important for Victor Frankenstein. He studies in Germany and becomes a scientist with
deep knowledge in this area. Not only for Victor, education also plays a major role for other
characters. For example, Elizabeth is sad because she [has] not the same opportunities of
enlarging her experience, and cultivating her understanding (Shelley 106) when Victor leaves to
visit France, the Netherlands, Scotland and England. So even for a woman, knowledge was
desirable. Due to the lack of a high education, it might be that Shelley was not able to speak any
foreign languages. She might come to terms with it and the probable wish to speak other
languages through the detailed description of the acquisition of a language (Shelley 74 79). In
conclusion, one can see that education played a key role in Shelley s life even if she was not
allowed to take part in it as much as she would have

Compare And Contrast Baroque Art And Baroque Art
Art in different periods carried various messages according to the artist theme based on different
artistic work. In many occasions when people wanted to pass the information, they can only use
paintings to communicate. The following two paintings were done in different time periods. The
first painting is Rococo type of art while the second is known to be a good example of a Baroque
type of art. Both paintings were aimed at passing messages of leadership though they were created
in different time periods. The first painting shows more of a kingdom that valued women while the
second painting shows a type of kingdom that valued their written law. Artistic works done in

The light of the picture is relatively dark comparing to the portrait s face. In his paintings,
Rembrandt exhibited knowledge of classical iconography, where he adapted his skill to fit his

deeper artistic value under the pictures. Many artists connect Baroque art with it. When it comes
to Baroque art, which was the type of art that comprised of painting, sculpture and architecture.
Baroque art was known to reflect more on the religious tension of the time. Most of the artists
reflected more on the desires of the Catholic Church in Rome, where the Roman Catholic was
trying to affirm itself in the wake of the Protestants reformation. Most of the Baroque paintings
were aimed at exhorting the divine majesty of the church, but the primary purpose of most of
these paintings was to strengthen kingdoms reign under the religious influence like Spain and
France. The Catholic Church dominated these two nations. Most of the paintings which were
created that time period tried to compare both Catholic and the Protestants religions. The
primary aim was to show how Protestants had less religious content when compared to the
Catholic religion. Most the Baroque paintings were intended to persuade people not to be an
apostate. However, most of the Baroque paintings were designed to affect the public. Catholic
inspired a Baroque art that was done on a large scale. Most of the places where these paintings
were found were churches and palaces. Artists of Baroque art were known to portray a sense of
movement by their work, by the means of swirling spirals and upward diagonals. They made good
use of extravagant color schemes, and this was aimed at dazzling as they surprised the targeted
audience. As time went on, there were some people who started criticizing Baroque art

What Is A Gap Year Essay
Many students feel a large amount of pressure and stress from school and the workload that
comes with it. The U.S. is strict when it comes to going to college; often you are expected to go
right out of high school, but what if we were not as strict and more lenient. People in England or
Australia wait a whole year after high schoolto go to college, this is called a gap year. Gap years are
very beneficial and helpful for students, however every great idea has its flaws.
A gap year is, of course, a year, where students after high school in some cases explore some part
of the world or a culture, with most kids exploring their interests or figuring out who they are and
what they want to do in life. Many colleges in the U.K. are far more likely ... Show more content on

With reference to specific examples, critically discuss the contention that cities are becoming
increasingly polarised in the contemporary world.
Polarisation is a term that usually refers to extreme of two extreme situations . In this context,
social polarisation is examined in detail. Social polarisation is an expression associated with the
segregation within a society that may emerge from income inequality, real estate fluctuations,
economic displacements etc. and result in such differentiation that would consist of various social
groups, from high income to low income (Moulaert, F. et al. (2003)). This essay will outline the two

can be argued that however, the growth of employment in the clerks and service workers and shop
and market sales workers (see table 1) contradicts the theory. This occupational group mainly
consists of middle income occupation and their growth made up for the loss of those in the middle
income manufacturing sector. It can be concluded that although Cape Town has seen a marginally
polarizing employment growth (Borel Saladin, Crankshaw, 2009; 658) in the past twenty years, it
has not seen an absolute decline in middle income employment and therefore does not agree with
the social polarizing thesis.

The Great Man Theory Was A Popular 19th Century Idea
Traditionally teams are built by putting a group of people together without considering many traits
or characteristics about those people, then expecting them to work together in a productive manner.
Often times this does not work well at all, particularly if the person in charge is unfamiliar with the
team concept themselves. Teams have to be cohesive in their ability to make decisions and handle
projects within their organization. Sometimes cohesiveness causes team members who are not
adept at working with others to push back at the team and this causes friction within the team. Team
buildingmodels have been developed over the years to make teams work.
The problem of working teams has been something that researcher and theorists have been
studying for years. Many of these researchers and theorists have developed a standard way to
develop teams and team skills. A plethora of team development books have been written and
team consulting firms have popped up all over the world. The Great Man Theory was a popular
19th century idea according to which history can be largely explained by the impact of great men
, using their power in a way that had a decisive historical impact. These great men always had
impressive results from their teams because of their leadership qualities. The historian Thomas
Carlyle enforced this theory with his statement The history of the world is but the biography of
great men. According to Carlyle, effective leaders are those gifted with

Social capital refers to the relationships that promote mutual benefits and enable the effective

Pericles Lion And The Sea-Onion Analysis
he Lion and the Sea Onion. Most self respecting artists would pick the former as the subject for a
monument and dismiss the latter. Yet, the man behind the moniker of Sea Onion cannot be so
easily dismissed. Pericles, the great Athenian statesman, was nicknamed
Schinocephalos
, or Sea Onion, by contemporary poets because of the large size of his head ( Pericles , History.com).
The Lion of Justice, in this case, refers to King Henry II of England ( King Henry II Biography ).
On the surface, both Henry II and Pericles appear to be equally great leaders who made lasting
impact on Western civilizations. Henry II established the English Common Law, which ensured
the same laws applied everywhere in the country (Hinds 60). He also laid the foundation for a
unified Britain by claiming Scotland and Ireland as parts of his realm (Morgan 143). Pericles
united the Greek city states into an empire known as the Delian League with Athens at its center (
Pericles , University Press Inc). Under his leadership and patronage, arts, literature, and philosophy
flourished, creating a cultural legacy that shaped all areas of Western thinking. Pericles also led the
restoration of the Acropolis and the ambitious construction of the Parthenon (Nardo 10). But
looking beyond their accomplishments, these two historical figures differ greatly in their
motivations and personal conducts. Arguably, two of the most essential traits of a good leader are
integrity and dedication to the common good. Using these qualities as a metric for comparison, we
will see that Henry II falls short while Pericles is clearly deserving of a monument in his honor
.
Both Henry II and Pericles were highly driven and ambitious. But while Henry was fueled by the
desire to glorify himself and his reign, Pericles wished to glorify Athens and its people. Henry II
wanted to reclaim lands that were previously under his grandfather s rule. He used force and
threats to claim lordship over Wales, Scotland, and Ireland (Hinds 12). In his mind, it was his
birthright. As a general and statesman, Pericles also helped reclaim land (noticeably Delphi) for
Athens ( Pericles , Bio). But rather than conquering neighboring poleis
, Pericles chose to focus on making Athens a city

Real Estate Properties And Residential Properties
Real estate valuation is also known as property valuation or land valuation and defined as valuing
the real estate property. There are two types of real estate properties: commercial and residential.
Residential properties are meant for single family homes whereas commercial properties are meant
for offices, apartments, retail, or industrial buildings. The valuation of real estateproperties is
necessary, and there are various ways to value real estate properties. There are two types of real
estate properties, and these are commercial and residential properties.
Residential property is a property, building or flat that is designed solely for the purpose of use by
a person or a family to live in on a day to day basis. Commercial property is a property which is
designed for the purpose of manufacture of a product or for the sale of goods and services. Hence,
residential property is for an individual or a family for living purpose while commercial property is

Commercial leases have larger durations than that of residential leases. Commercial lease has

Date and time: Thursday 4th October 2012, 10:00hrs
Judge: Mr. de Vries

Overview of the Facts and the Compensation Sought
On the 1st of January 2011 the claimant Mr. de Jong purchased a buggie through a German

Misrepresentation has occurred in the sense of providing misleading product description inducing
the claimant to buy the product i.e. to conclude the contract with the trader.
Because of the defective performance the council of the claimant suggests that the buggy shall be
replaced, as special performance on the part of the trader, with a similar product. This can be
established by Article 6:103, which states that the compensation can be paid in another form than
only money, in this case, a new buggy.
Tort Law Wrongful Act: Dutch Private Law (BW)
Tort Law and Wrongful Act shall be used in the claimant s case because of the fact that the
purchase price of the buggy has been below €500. Therefore the rules and regulations of product
liability do not hold, and the case needs to be considered in terms of a wrongful act.
First of all the fact that Mini Coza has manufactured a defect product, and furthermore the fact that
Mini Coza has let this faulty product to enter the market, which finally led to a one year old child
to fall down to the ground and hurt himself, can be considered as a wrongful act. This is
established by Article 6:162 in the Dutch Private Law, which measures the wrongful act.
Furthermore, this wrongful act has caused damages to the claimant s son, which can be represented
by the monetary damage (the medical costs) worth of €2500.

18 19). Lincoln grew up dirt poor in the bare Kentucky frontier, his mother dying when he was
nine years old, and his father having a paltry, insignificant relationship with the young Abraham.
Lincoln quoted Thomas Gray s poem, Elegy, when describing the conditions of his youth, The
short and simple annals of the poor. (pg. 20). As soon as he could, he sought independence from
his father and began life on his own. He eventually settled in New Salem, Illinois where he
joined the Debating Society. As Foote puts it, though at first the charter members snickered at
his looks and awkwardness, presently they were admiring the logic and conciseness of his
arguments (pg. 22). One member of the society claimed all he lacked was culture (pg. 22).
Lincoln was respected for his intelligence, but derided for his social skills and poor background.
Certainly this part of Lincoln s life is of the least importance, but it serves a purpose for Foote,
who aims to portray Lincoln in a more vulnerable part of his life, when he wasn t revered like he
would later be, but viewed with pity as a backwoods hick. This serves as a shock to the reader,
disarming us of any romantic notions we have of Lincoln s early life. Lincoln unquestionably

budgeting, management can make sound decisions about the implementation and management of
contracts. The effectiveness and efficiency in which the agency is run and the manner in which the
contract is managed is grounded in the effective practice of these principles.

Emmanuel Kant Research Paper
Before critical theory was fully developed and defined, many philosophers played a part
influencing future thinkers in the way we critique reason, ourselves, society, and ultimately how we
can strive towards autonomy and freedom. These four German historical figures were: Emmanuel
Kant, J.G. Fichte, G.W.F. Hegel and Karl Marx. Emmanuel Kant was born in 1724 and died in
1804 in Konigsberg, Prussia. He was one of nine children and grew up in a strict religious
household. From the age of 16, Kant spent most of his years in life at the University of Konigsberg
as a student and completing his own research. As a youth, he studied philosophy, sciences, and the
works of Isaac Newton. Although Kant is known for his philosophical contributions, he made major
contribution to astronomy in the 1750 s and 60 s by theorizing about our solar system and the Earth
s rotation.
Kant became interested in the structure and limits to our own knowledge. Three critiques were
written between 1781 and 1790: Critique of Pure Reason, Critique of ... Show more content on

In addition to his philosophical views, he wrote Addresses to the German Nation (1808) which
shared his views on the nationalism of Germany. As a philosopher, Fitche would connect the ideas
between the subjective idealism of Kant and the objective idealism of Hegel. (Bronner)
G.W.F. Hegel was born in 1770, Stuttgart, Germany. As a German Idealist he was very influential
in the 1900 s. Hegel spent most of his career as a tutor, teacher, and university professor. Known
in history as a German Idealist, he was influential during the 1900 s. His works include:
Phenomenology of Mind (1807), The Science of Logic (1812), Encyclopedia of Philosophical
Sciences (1816) and the Elements of Philosophy of Right (1820). His writings are rooted in history
and view historical realities that are constantly changing or in

Remini has argued? Or was his intent to destroy the tribal culture and to get rid of the Native Americans, as Anthony F.C Wallace has argued? Robert V. Show more content on Helpwriting.net ... Jackson s removal policy did not sit well with a lot of groups; many were uncomfortable about it but agreed it had to be done. President Jackson showed great leadership apart from everything else, and handled the Indian Removal act when no one else wanted to address the growing issue of Indian problem. Most government officials saw little to gain from addressing this and would do nothing. President Jackson wanted everything to go smoothly so that the American people would see that he was humane and that this Treaty would benefit both the Indians and the American nation at large. With Jackson located too far away to oversee the actual removal of the Choctaw Nation, they would endure mismanagement, theft, corruption, and inefficiency on a level that would lead to their destruction. Jackson would be deeply offended and the removal of the Choctaw Nation would become one of the worse horror stories of modem era. Anthony F.C ... Get more on HelpWriting.net ...

  • 10. The Consequences Of Video Game Violence In Video Games Violence in video games is well known for toeing the line between entertainment and immorality. The controversy began as early as 1976, when protestors destroyed an arcade game that revolved around hitting human like creatures with a car. As computers grew more advanced in the next two decades, video game violencebecame increasingly realistic ( Background of the Issue ). This prompted the creation of the Entertainment Software Rating Board, commonly abbreviated ESRB, in 1994 for parents to make informed decisions regarding the content their children were exposed to. The 1999 shooting at Columbine High School fueled the debate further, drawing potential connections between virtual violence and real world consequences ( Background of the Issue ). In the years following, laws regarding the sale of video games with graphic violence sprouted up across the nation. Even the Supreme Court was involved ( Background of the Issue ). Today, as many as 97% of US kids age 12 17 play video games, contributing to the $21.53 billion domestic video gameindustry ( Violent Video Games ). Critics of video game violence argue that it directly increases a person s violent behavior and lowers their tendency to act for the benefit of others. Defenders of video game violence argue that media coverage of video game violence is heavily biased, studies that link it to acts of violence are flawed, and that video game violence is a harmless outlet for emotions of aggression. Critics of violence in video games believe that it increases an adolescent s tendency toward violent actions. Multiple credible organizations also view playing violent video games as a statistical detail affecting a person s aggressive tendency. It can be concluded that although Cape Town has seen a marginally polarizing employment growth (Borel Saladin, Crankshaw, 2009; 658) in the past twenty years, it has not seen an absolute decline in middle income employment and therefore does not agree with the social polarizing thesis. • 31. The Great Man Theory Was A Popular 19th Century Idea Traditionally teams are built by putting a group of people together without considering many traits or characteristics about those people, then expecting them to work together in a productive manner. Often times this does not work well at all, particularly if the person in charge is unfamiliar with the team concept themselves. Teams have to be cohesive in their ability to make decisions and handle projects within their organization. Sometimes cohesiveness causes team members who are not adept at working with others to push back at the team and this causes friction within the team. Team buildingmodels have been developed over the years to make teams work. The problem of working teams has been something that researcher and theorists have been studying for years. Many of these researchers and theorists have developed a standard way to develop teams and team skills. A plethora of team development books have been written and team consulting firms have popped up all over the world. The Great Man Theory was a popular 19th century idea according to which history can be largely explained by the impact of great men , using their power in a way that had a decisive historical impact. These great men always had impressive results from their teams because of their leadership qualities. Yet, the man behind the moniker of Sea Onion cannot be so easily dismissed. Pericles, the great Athenian statesman, was nicknamed Schinocephalos , or Sea Onion, by contemporary poets because of the large size of his head ( Pericles , History.com). The Lion of Justice, in this case, refers to King Henry II of England ( King Henry II Biography ). On the surface, both Henry II and Pericles appear to be equally great leaders who made lasting impact on Western civilizations. Henry II established the English Common Law, which ensured the same laws applied everywhere in the country (Hinds 60). He also laid the foundation for a unified Britain by claiming Scotland and Ireland as parts of his realm (Morgan 143). Pericles united the Greek city states into an empire known as the Delian League with Athens at its center ( Pericles , University Press Inc). Under his leadership and patronage, arts, literature, and philosophy flourished, creating a cultural legacy that shaped all areas of Western thinking. Pericles also led the restoration of the Acropolis and the ambitious construction of the Parthenon (Nardo 10). But looking beyond their accomplishments, these two historical figures differ greatly in their motivations and personal conducts. Arguably, two of the most essential traits of a good leader are integrity and dedication to the common good. Using these qualities as a metric for comparison, we will see that Henry II falls short while Pericles is clearly deserving of a monument in his honor . Both Henry II and Pericles were highly driven and ambitious. But while Henry was fueled by the desire to glorify himself and his reign, Pericles wished to glorify Athens and its people. Henry II wanted to reclaim lands that were previously under his grandfather s rule. He used force and threats to claim lordship over Wales, Scotland, and Ireland (Hinds 12). In his mind, it was his birthright. As a general and statesman, Pericles also helped reclaim land (noticeably Delphi) for Athens ( Pericles , Bio).
